Excerpt: As supervisors know safety is the responsibility of each person in charge of others. Top management has the responsibility to provide safety policies, procedures, and rules. Top management must also provide the necessary means for training, hazard identification, and correcting unsafe conditions. To be sure, each manager and supervisor in the chain of command is held accountable for the actions of the employees reporting to that manager or supervisor. That’s the legal obligation that comes with the job. Supervisors are legally responsible for implementing and enforcing safety policies and procedures, and rules. When we say legally that means you’re legally responsible to the company and to the state in which you work. If the company has no written safety rules or procedures, basically you’re off the hook. However, the vast majority of companies do have written safety rules, therefore the supervisor is expected to faithfully enforce all safety and health policies, procedures, and rules. What happens in the event an employee is seriously injured or killed in the workplace. Perhaps you’ll get an inspection by OSHA to determine if any safety violations contributed to the accident. If the company was at fault perhaps a monetary penalty will be assessed, nothing to do with the supervisor. Perhaps a serious accident or fatality will trigger an investigation from the local district attorney’s office. They too may investigation the cause of the accident and make a determination….
